Even assuming hypothetically it was an accident, how the fuck can you excuse a police officer firing their weapon when they can't see who or what they're shooting at? A critical and horrific error of judgement caused someone to die, that's the absolute best case scenario here.

I hope they don't go for 1st degree. The burden of proof may be too high to convict her. We do know, for sure, that she murdered him though.

? Well if someone has broken into your house and you're half asleep, you're probably not gonna follow their commands and will probably hide. I'm not aware of if the victim had a warrant or something, but I doubt he did so he wouldn't expect cops at all in that case.

There is another possibility that she might have been investigating a possible situation if she noticed that the door was ajar and got overzealous. But I guess she admitted that she entered the wrong apartment as an accident so, nm...

Most folks don't expect to have trigger-happy cops come barging into their homes with guns blazing.

The very best thing that the police departments can do in these situations is to charge the cop as if she was a civilian. That means NO exemptions from the law for killing somebody. Otherwise, expect public attitudes towards cops to divide even further.

The truth is, cops can kill with impunity, which they are well aware of. Making cops responsible for their actions would be a good first step. They can start with this killer cop right here.

I believe that second degree, or maybe third degree murder are based on a heat of the moment action as opposed to a calculated, conscious decision.

Murder 1 requires a lot of proof to get a conviction. Going for a lower charge will ensure a conviction. They can likely get her on any charge that isn't dependent on premeditation.

Cops can still act in an official capacity when they are off the clock. It's the reason they're able to take off hours security jobs and wear their uniforms while doing so.

But I don't think there's any defense for firing blindly into a dark room. You have no idea who you're shooting at, plus it's a fucking apartment with other peoples' homes right on the other side of a wall/ceiling/floor. She's lucky only one person died

also cop commands usually are bullshit. in many cases of these shootings the cop claims they gave a command but if you watch the footage the command is given and then they shoot like half a second later, before the person can even do the command. or sometimes they do the command and shoot literally at the same time. and in the cop's mind, that's ok. to cops, all they have to do is say the commands technically out loud. and that absolves them, no matter what the details are.

To be fair, I haven't really seen anyone defending her for the claim of him not listening to her commands. Pretty much everyone seems to agree that he had no reason to listen to her commands.

That being said, I love how the affidavit is basically trying it's best to make it sound like she was simply acting on her cop instincts.

"The door was ajar, I had to investigate! Then he didn't listen to my commands. MY commands! I'm a cop, he should have listened"
