Because copyright terms are way too long and because a lot of old games are either unplayable for various reasons (never remade, never localized, old hardware and games being prohibitively expensive via second-hand market and do not exist first-hand ect)

I dont buy this. Most people are still going to try to pirate Mario and Final Fantasy games, even if the old dead ones become legalized somehow.

A lot of people sure, but many people, myself included, only download games we can't play otherwise. I get that I don't have a "right" to play any game, but there is no other way for me to play such gems as Sweet Home or Live A Live without translation patches other than learning Japanese and purchasing a $350 Japanese Famicom and a $150 copy of Sweet Home.

And then there are rom hacks and fan games that are amazing and only playable on emulators (or modded consoles)

I don't really care if people pirate, but if you're pirating a game you can purchase, it's still piracy imo.

From non-second hand market I absolutely agree (like games available on the PlayStation Store, ports to pc, virtual console etc would be pirating)

That said, you cant exactly pick and choose how you enforce this shit. Its really an all or none deal

That's the big thing here. Personally my opinion is that copyright for games should be 14 years past the last release, that way the games that don't get rereleased enter public domain and can be freely played by anyone. I feel that 14 years is long enough for all non second-hand copies to be no longer available.

Piracy is piracy no matter how you look at it.
It is all a matter of different levels of acceptance.
Some people have no problems pirating games so new so they are not even in the stores yet.
Some people only pirate games if the console is old enough, at least 2 generations old seems to be an acceptable standard.
Some people only pirate games if they are old enough, like 30 years.
Some people only pirate old games that would cost too much to play, like importing a Japanese console, expensive cartridge and learning a new language.
Some people are pokeroms, just collecting it all and rarely play it.

i dont really care for the most part about most modern games because whether the pirate would have actually bought it in the end is such a gray area that the entire situation becomes a mess

but pirating retro shit is like... negative care. only idiots who love getting fleeced, people who enjoy the novelty of stuff like the nintendo classic mini consoles, or people who are too lazy to walk from their console to their computer buy retro games with no changes

Legally, everything that violates copyright is, well, violating copyright. But hopefully copyright laws are eventually changed and/or copyright owners contribute to some sort of museum or rental service for older media.

I might have been a big pirate hypothetically when games started forcing DRM and the only way to get the clean version was the pirated copy.

There was also some games that purposely broke if you didnt have a specific graphics card like Empire Earth II which a specific fix was a notepad.

Clients like steam has changed my hole approach as steam is consumer friendly. Not only can I have all my games in one place even better I can redownload at any time.

Keep in mind there was digital titles during this time but EA literally made you rebuy them or pay a fee to make you redownload digital games you bought... oh and there was an extra fee to download digital games.....

I would only consider doing it if I have no other realistic means of obtaining the game.

Take The House of the Dead, for instance. Im not paying $140+ for a used copy of the game in acceptable condition from God-knows-where. And Im also not scouring the Internet for a Sega in good condition.

Its very frustrating when developers give up or refuse to port a popular game to newer-gen consoles.
