How do streamers get away with using famous people's likenesses as emotes? They're definitely not getting permission. And use of the emote is not free. You have to pay the streamer to use them. I could be wrong, but how is that not lawsuit-worthy? I don't get it.

It's mostly due to certain copyrights. I've seen a couple streamers who couldn't submit particular cartoon or video game based emotes for that reason. A person's face likely doesn't apply.

How so though? You have to pay the streamer in order to use them. Couldn't that person easily attempt to sue? Or get them with some sort of legal implication?

I'm not sure. Copyright is a funny thing. I see plenty of people online who create fanart of copyrighted characters and sell prints, but then you consider fan-made video games and roms which can't be sold.

fair use

Is it really fair use to just directly take someone's likeness and charge people money to use it on your stream?

The above post is literally and objectively right.

to be fair i have no idea how that works
is it only for people who have subscribed (the use of those emoji)?

then you'd probably have to be able to argue that they're making money off of those likenesses
which is lol good luck

It probably depends on whether said person's likeness is licensed/copyrighted or whatever, and/or whether the person cares/complains about the use of his or her likeness.
