An amendment blocking President Trumps bailout of Chinese telecom company ZTE offered by Congressman C.A. Dutch Ruppersberger (D-MD) and Congresswoman Rosa DeLauro (D-CT) unanimously passed the House Appropriations Committee today. The amendment will be included in the Fiscal Year 2019 Commerce, Justice and Science Appropriations Bill when it comes under consideration by the full House of Representatives next month.

Congressman Ruppersberger has long suspected ZTE is used by the Chinese government to spy on Americans through the cell phone components they manufacture. He traveled to Hong Kong and interviewed ZTE executives before co-authoring a bipartisan report on the threat as then-Ranking Member of the House Intelligence Committee in 2012.

ZTE was sanctioned in April after it was caught shipping American-made goods to Iran and North Korea. President Trump earlier this week, however, announced that he is directing the U.S. Commerce Department to help the company, citing Chinese job losses.

This amendment, which passed with the unanimous support of my colleagues on both sides of the aisle, shows that, when the United States enacts sanctions, we stand behind them, Congressman Ruppersberger said. It will also prevent a foreign company that is beholden to its government and that ignores embargoes from infiltrating the devices and networks that are now indispensable to American life.

Specifically, the amendment prevents the U.S. Commerce Department from renegotiating sanctions on ZTE, preventing them from receiving support from the U.S. vendors on which they depend.

April 2018 The U.S. Department of Commerce announced today that it would ban U.S. companies from providing components to ZTE because the Chinese company failed to comply with the terms of a disciplinary agreement reached in March 2017 arising from U.S. export law violations. The ban, slated to last seven years, also prevents others from reselling U.S. components to ZTE. The action has a direct effect on optical component and subsystems vendors who had ZTE on their customer rosters.

In March 2016, the Department of Commerce slapped export restrictions on U.S. technology to ZTE under suspicion that the Chinese communications systems house had sold equipment to Iran and North Korea containing U.S. technology between January 2010 and early 2016 (later amended to April 2016). Such U.S. technology was banned from export to the two countries at the time (see "ZTE faces export sanctions from US Department of Commerce"). The company agreed in March 2017 to plead guilty to a series of related charges as part of a disciplinary agreement that would lift the technology supply ban (see "ZTE admits guilt, settles export squabble"). The agreement included $1.19 billion in fines, with $300 billion suspended as an inducement to adhere to the agreement's terms during a seven-year probationary period. Those terms included the promise that ZTE would take disciplinary actions against employees identified as participating in the illegal activity. The agreement also contained provisions for a seven-year ban on U.S. technology transfer to ZTE that also would be suspended as long as ZTE adhered to the agreement.

Within three days of the Chinese government agreeing to provide $500 million in loans to an Indonesian theme park that the Trump Organization has a deal to license President Donald Trump's name to, the president stunningly ordered sanctions be rescinded against a major Chinese telecom company.

As AFP reported via the South China Morning Post last week, the developer of that project just outside of Jakarta had secured the half billion in funding, in addition to another $500 million from Chinese banks, 72 hours before Trump's Sunday tweet on the Chinese telecom company ZTE. Trump's family business has a deal with that developer to include the Trump name on the resort, which also includes hotels and a golf course.


"President Xi of China, and I, are working together to give massive Chinese phone company, ZTE, a way to get back into business, fast," Trump tweeted Sunday. "Too many jobs in China lost. Commerce Department has been instructed to get it done!"
