That doesn't fly on eBay unless you set the condition as For Parts/Not Working. A buyer will win a claim against you if you set it as anything else, regardless of what you put in the description.
I sell stuff on eBay all the time and have never had an issue where I said something was untested (like I don't have a Game Cube but sold games untested).
