Dear Moneyist,

Before I married my wife two years ago, she had huge amounts of debt to her name, including large amounts of student loans. After we married, we diligently almost paid everything off, helped by my salary being three times that of my wife.

She recently asked for a divorce, saying she was taking the house and my retirement. My question is: Does the fact we paid off her debts she held before get spread evenly? Had I not paid all of her debts our net worth would be near the same with a better outcome for me.

Weve only been married a few years, and frankly I cant help feeling taken advantage of. The only advice I can find discusses whose responsibility the student loans would be, but now it just seems that she got me to pay all of her debts, and got some new stuff, while I threw away years of my life.

Please tell me theres hope.

A prenup is basically marriage insurance, in case you're the victim of an outdated law that says that your assets are shared regardless of who brought what into the equation.

But its far from the same. One is based entirely on your relationship to a person, the other is based on a million other factors. A prenup increases your risk for divorce by acknowledging second thoughts and creating some resentment.

She played YOU like a simp....and YOU allowed yourself to be played like a simp.... It is YOUR FAULT! At least you did not have a kid with her...so things could be a LOT worse (like 20 years of child support payments). Let's hope you learned a very important lesson:

NEVER get married/cohabitate (unless she is financially better off than you)....There is NO reason for it! Why buy the Cow? Free milk is everywhere!!!

PS: If she suddenly (before the divorce is final and the following nine months) tells you that she is pregnant...MAKE SURE YOU GET A PATERNITY DNA TEST....and DON'T SIGN THE BIRTH CERTIFICATE.

I know my cousins now husband paid off all of her debts before they even got married and I don't know. she had some questionable conversations with my sister about 'who should she date'

but anyways they have been married and been together for quite some time, have a child together and stuff so meh. she also gained a bunch of weight once they got married and especially after they had a kid together.

but yeah I get the vibe she basically settled for him cos he was a good beta provider. whenever I see them together to get the vibe she fake loves him or something. it's like they lack this certain chemistry that couples normally have

All he has to do it say no to a divorce and fight her all the way. I've been to several dozen divorce proceedings and every time one party doesn't show up, they reschedule the court date and her lawyer gets paid more.

Regarding the man who paid his wife's student loans: this might not be transferable, but maybe the principle of it is. My sister married a guy who was accepted to medical school. My father paid for the cost of medical school and kept all the receipts. Upon their divorce (New York), my sister was able to establish a "financial investment" into his medical career. Thus the judge gave my sister a 15% lifetime interest of the proceeds of the medical practice. Could it not be stated that by paying the student loan, the guy "invested" into his wife career, thus, he is entitled in a percentage of the proceeds of such career?

Your only asking to get fucked over then, you need to protect yourself and a prenup is a way to do that.

I love my girlfriends but both of them already know a prenup will happen and they already agreed to it. They make good money too though so they are not dependant on my money, if either said no then I would know they are not trust worthy.
