On Monday, a high court in Gujarat, India, found a doctor, accused of raping his wife, not guilty because there exist no laws against marital rape in the Indian Penal Code.

The judge presiding over the case ordered the partial quashing of the FIR filed against the doctor at Idar in Sabarkantha district, Gujarat, by the latter's wife, who accused the former of subjecting her to mental and physical torture and forcing her to have oral sex.

The husband cannot be prosecuted for the offence of rape punishable under Section 376 of the IPC at the instance of his wife as the marital rape is not covered under Section 375 of IPC... which provides that sexual intercourse or sexual acts by a man with his own wife, the wife not being under 18 years of age, is not rape, Justice JB Pardiwala observed, Hindustan Times reported.

According to India Law Journal, Marital Rape refers to unwanted intercourse by a man with his wife obtained by force, threat of force, or physical violence, or when she is unable to give consent. Marital rape could be by the use of force only, a battering rape or a sadistic/obsessive rape.

While Indian Penal Code Section 375, which lists the definitions of rape and was amended to include more details in 2013, now covers oral sex, sodomy and penetration by foreign objects, it makes the exception for married women who are above the legal age.

Instead, the judge directed the police to book the doctor under Sections 354 (sexual harassment) and 498 (A) (husband and relative subjecting a woman to cruelty).

You cant make up crimes to get a conviction. The judge was just doing his job. Marital rape does not exist in India, so theyre making do until thats changed.

Places like India will sometimes be considered "Middle Eastern" because of cultural similarities and it makes them easier to group together. I'm aware India isn't technically in the Middle East and I'm sure all the people here dog piling know what I meant.

Its more of a grey area in Marriage what constitutes rape but it certainly is quite possible for rape to occur in marriage. Its laughable and sad to dismiss it entirely as a possible crime.

Simply put, no. Demographically, historically, linguistically, religiously, politically, India and the rest of the Middle East are all staggeringly different to the point that nobody in their right mind would ever remotely insinuate a tangential commonality beyond comparing any other groups of people from the most base of levels, much less outright suggest using a geographic term to imply a cultural connection. It's an absolutely nonsensical statement that only paints the person that's making it in an absurdly ignorant light.

I don't know how you can possibly say that when most are Islamic and despite being majority Hindu, Islam has still had a lot to do with shaping Indian culture as is referenced here

Nope, I did not claim that Islam isn't a factor in India, nor is that insinuated. But I pointed out that it's not geographically part of the Middle East and that culturally they are not considered part of the Middle East. Pointing out ignorance is not being condescending, acting high and mighty for being wrong and failing to advocate your point when everybody called it out is.

Just admit it, you made a dumb post and don't like being called out for it. It happens. I made a dumb post in a Dark Souls topic just a bit ago. It happens, move on. Don't double down on an illogical statement when everybody calls you out on it, especially when your point is now essentially Islam = Middle East.
