I ordered a computer for my brother using woot.com last week. A few days after it got here, I got an email about a shipping notification, and lo and behold, later that day a second one arrived. I waited to see if I'd get an email from the company about it before doing anything with the computer, and today, I did.

Hello,

We're reaching out to you about your recent order for the HP Omen. Due to a fulfillment error, these orders were accidentally double-shipped.

As our way of saying sorry, we've gone ahead and issued you a $50 coupon. Your coupon code is [coupon code here]. Please note that this coupon cannot be used on Gourmet.Woot, is case sensitive, and will expire on September 23rd.

I had a similar thing happen with a large coffee order from The Christmas Tree Shop last year. Like a dummy, I contacted them and told them they'd sent me 8 extra boxes. They told me they weren't going to send me a box to ship it back, that I would have to buy my own, and that if I kept the coffee I would be charged for it.

Not being one to be bullied by a company and their illegal practices, I made comments all over their social media bitching about having to pay for their mistake when all I was doing was trying to be an honest person.

Needless to say, I didn't pay for the coffee and they never sent me a box to return it. (After a month of emails, they finally just told me to keep the coffee, which is still collecting dust in my pantry as I type this.)

I ordered a jump drive from Amazon one day and they sent me two. I meant to send the other back, but I just set it on the microwave and forgot about it. I came across it later and just opened it and kept it.

But ideally you should tell them you got two.

Yeah, dude you should send that back. Theyre not going to let something that expensive go unnoticed. Theyve already basically said theyre going to charge you for it.

Its not like they dont know that they sent two. If you try to keep it, they are going to change you for it. Just get in contact with them and send it back.

They shipped two separate packages, both of which were scanned probably at HP and then weighed via whatever courier they use to ship. Can't argue you got an empty box and can't argue nothing arrived via shipping tracking. They know man, if it ever ended up in a legal route it'd be hard to argue you didn't get a 2nd one.

The argument wouldn't be that I didn't get a second one, it'd be that there was only ever a request and transaction for one of the item, and anything else sent by them would technically be unsolicited, right?

That said, I'm sure I'd feel really bad about keeping it, I'm mostly just curious how this all works from a law standpoint.

yes, by FTC standards that second package was unsolicited and thus legally a gift from the company. any actions the company takes other than offering to pay return shipping and asking you to send it back are illegal

That company look like it's big enough not to feel the loss of a single computer, so of course you should keep it.

The only bad thing is that someone might actually lose a job because they fucked up and you didn't return it.

But yeah, to go with the old saying screenshots or it didn't happen.

That's illegal. You can't be charged for an item sent to you without your consent. That's to stop scams where you'd be sent things you don't want and be charged for them.

They can't charge you for it (you didn't authorize that charge), but they can demand it back and sue you for the value if you don't return it.

This is NOT an unsolicited package. This is an accidental double shipment, and they're paying to fix their screw up.

The best thing to do would probably be refuse delivery of the second package.
