Is it wrong to inadvertently discriminate against black people?
For example, is it wrong for a bank to reject or otherwise charge premium on loans to people who have questionable credit history or other public records, even if a certain race is over-represented in that population, despite the fact that credit history and other public records have been shown to be predictive of default?

Is it wrong to inadvertently discriminate against homosexual people?
For example, is it wrong for a life insurance company to reject or otherwise charge premium on a policy to people who take HIV prophylactic drugs, even if a certain sexual orientation is over-represented in that population, despite the fact that the taking of HIV prophylactic drugs has been shown to be predictive of mortality?

Etc

Where do we draw this arbitrary line of discrimination?

So one example against ... what? Like millions of discrimination lawsuits that turned out true?

Basically, you are arguing we should go back to discriminatory practices because someone might abuse the system?

Thats not discrimination. Thats people that dont qualify for services that also happen to be a protected class. Their protected class status has nothing whatsoever to do with being denied entitlements.

Is it discrimination if you can prove that there was absolutely no malice towards homosexuals or people with HIV in general? No. Can you prove that? Harder to say.

You asked where the line is. I told you. Each case is obviously going to be different and I'm not sure why you just keep lobbing scenarios at us. Do you only want one specific answer or do you have some sort of agenda?

Also, just because something isn't discrimination, doesn't mean it's not the wrong decision.

Black applicants could no more successfully claim that they were denied equal protection than could white applicants who also failed to qualify. The conclusion would not be different in the face of proof that more blacks than whites had been disqualified. That other black applicants that also failed to get service, alone, does not demonstrate that the black applicants individually were being denied equal protection of the laws by the application of an otherwise valid qualifying test being administered for prospective services.

Nor, on the facts of the hypothetical, would the disproportionate impact of the denial of services warrant the conclusion that it is a purposeful device to discriminate against black applicants, and hence an infringement of the constitutional rights of the black applicants.
