A New Mexico police officer with a history of being reprimanded for on-duty crashes filed a lawsuit against a woman whose 6-year-old son was killed when the officer slammed into their vehicle while speeding to a crime in progress.

Jonathan McDonnell of the Albuquerque Police Department filed the civil suit against Antoinette Suina, charging she "failed to yield to an emergency vehicle" when she turned in front of his speeding patrol car in 2017.

McDonnell's suit counters one Suina filed in January against him and the city of Albuquerque, charging the officer's "deliberate, intentional, and/or reckless" conduct led to the crash that killed her boy and left her and her 9-year-old daughter, Adriana, severely injured.

"Having killed Ms. Suina's son, it's somewhat offensive that he would turn around and sue her and heap more tragedy on this family," the mother's lawyer, Geoffrey Romero, told ABC News Thursday. "In effect, it's blaming her for the death of her son."

McDonnell's attorney did not respond to a request from ABC News for comment.

Following the wreck, the Albuquerque Police Department released to the Albuquerque Journal newspaper a list of five on-duty crashes and one unauthorized pursuit McDonnell had been involved in since 2009 in which he was reprimanded. He was suspended in three of the incidents, according to the report.

A Bernalillo County sheriff's deputy who investigated the crash wrote in a report, obtained by ABC News, that McDonnell was going 67 miles per hour when he hit Suina's SUV. The deputy noted that "the design of the roadway and intersection makes it hard to see oncoming vehicles in both directions when there are vehicles in the turn bays to proceed east and west."

The deputy, according to the report, concluded, It is my opinion that Officer McDonnell was operating his vehicle at a speed too fast for conditions at the time, however, Officer McDonnell was authorized to operate his vehicle in an emergency response." Due to "multiple factors involved" in the crash, the deputy wrote, "I do not feel charges are warranted at this time for either driver."

Fire this reckless prick. When code 1 driving, the responsibility for the safe operation of their vehicle is AT ALL TIMES the emergency driver's responsibility. The nerve of this asshole.

The APD has serious troubles recruiting officers and they have a massive shortage right now. Not an excuse to keep loose cannons like this around, but that's the reason.

Again, in code 1 driving it is 100% the emergency driver's responsibility to maintain control and safety. They're the ones breaking road rules. They're the ones driving above posted limits, driving on the wrong side of the road, the ones breaching red lights and stop signs. They're the ones with the training, the experience. Civilians do not expect them, and will do strange and panicky things when they notice (IF they notice). Its up to them to predict hazards and avoid them. It doesnt matter what they're driving too. If they wreck, they're not going to get there, and they'll likely further delay the response as a new unit is tasked and dispatch have to deal with the new incident they created.

In Orlando police and other emergency vehicles slow down damn near to a stop and blare the sirens while slowly creeping through the intersection. I had a former coworker get hit by a cop who didn't do that and he won the case because the cop just flew through the intersection. In that case though the cop didn't use his siren just had the lights on which isn't the most visible thing at 12pm in sunny ass florida

As said, different case. In your case, mother definitely had fault, the occupants weren't properly strapped in, though I think more fault still goes to the one who hit them going at an insane speed.

in this case, she didn't see the cop. he just appeared out of nowhere and slammed into her. then he charged her with failing to yield, as if she had a chance to yield. she didn't. she didn't know the cop was there until he crashed into her. the cop was in the wrong. she is innocent. cop should be in prison

Police are essentially above the law in this country. They rarely (if ever) go to prison for committing offenses that citizens would be locked away for the rest of their lives for. Incidents like this only prove the point, and show the general attitude of cops everywhere in America.

I used to live in Albuquerque. I learned right away that the cops there are something you do your best to avoid.

Albuquerque used to have the distinction of having the most lethal (city) police force in the nation. I do not know if that is still the case, but I would not be surprised if it was.
