The selling of the drug, which is a felony, did directly result in death. You can tap dance around all you want, but trying to take the blame off of the shoulders of the person who knowingly provided the instrument of someone's demise, especially when said instrument is an illegal narcotic, is 2nd degree murder.

Also note, genius, that it doesn't specifically state a robbery. Laws cover more than their original intent.



I wouldn't be too surprised, but this guy may not have knowingly consumed fentanyl. It is often laced in heroin or even sometimes in pills pressed as oxycodone or whatever pharmaceutical opioid


It was knowingly sold to him, though, which further strengthens the case against the dealer.

It is not. Again, you don't seem to be able to read the law properly. The death has to occur DURING a felony. Providing someone with something potentially dangerous is not murder, no matter how much you try to stretch the law to suit your desires. Also ,genius, I brought you robbery to show an example of actual homicide during a felony since you couldn't wrap your head around it. The law literally says the defendant has to be engaged in a felony at the time of the homicide. A good lawyer will beat the charge easily.

You can have legal consequences for selling to a drunk person yes.
