I'm not a huge gamer, but I enjoy fun multiplayer games like new super mario bros and Wii sports, so I thought it would be fun for the family. I found an Ebay auction which didn't show an actual picture of the product, but showed a scanned picture of the box. Therefore I didn't know the real condition. But I decided to buy the product anyway.

A week comes by, I receive the product and theres NO controller, NO power supply or av cables. Not even a stand to put under the wii. I immediately contacted the seller. Not rude or anything. I figured he was an Ebay store and they must have mixed up two orders. The seller got super defensive, claiming it was clearly in the description.

I double checked, he isn't wrong. It does say "wii console only", but it's in VERY small text. Everything else is in big letting, and the picture shows a full wii set, albeit it was a scanned picture. In my opinion, the subject of the listing should ALWAYS say "wii console only", but it didn't. It was also the price of a regular wii bundle.

Should I complain, or am I in the wrong?

Unfortunately you fell for a pretty common (but shitty nonetheless) practice done by a lot of sellers. It doesn't sound like he described what he was selling you incorrectly so I doubt there's anything you can do. Hopefully this is a teaching moment for you to carefully scan these auctions before you buy.

Sorry mate, but the law says that such disclaimers must be prominent to where they are reasonably noticable, which is of course at the discretion of a judge who will say "Your picture contradicts the description and everyone on the planet has a camera phone, you knew what you were doing. Yea, I remember watching a case on Judge Judy (I think it was) where a woman was selling pictures of cell phone and in tiny print it said you were buying a picture and not an actual phone

Judge ruled it was misleading and basically false advertising and the person got a full refund

You might have an actual case TC, but odds may still be against you

She ruled it as misleading in that case because the seller had the weight listed at the actual weight of the phone

However, all the seller sent was a piece of paper with the picture of the phone. Since the weight of the picture was not the weight of the phone, she ruled in the plaintiff's favor. If the TC can find an obvious technicality like that, then he's sure welcome to try

Yeah definitely a lesson learned. Although these type of people are a real piece of work and Ebay should come down on these people. But they don't, because they're making money off idiots like me.

Guys, it's ebay. It's a buyers market, with the deck stacked in their favor. TC can probably get his money back. Especially if he threatens to give the guy a low rating

Yeah definitely a lesson learned. Although these type of people are a real piece of work and Ebay should come down on these people. But they don't, because they're making money off idiots like me.

Where else would I go? Craigslist is a decent option, but I don't like CL in general.

Ebay took the side of the guy who bought my "dark orange" jacket that he claimed was actually red

so if that whiny moron can return an expensive down jacket because he decided red and dark orange are completely different products, then you might be able to get your money back

neither of you were 'wrong'. it's an extremely common tactic used in ebay selling. remember the stories about consoles going for full price when they were actually only selling the box?

if you're an experienced ebayer, then it's p much status quo. since it sounds like you're relatively new to it, i feel for ya, cuz it definitely does suck.

wouldn't hurt to try to contact ebay but not sure if you'd get your money back since it is such a commonly known tactic. ebay's not gonna punish you for trying, though.

escalate to ebay. they don't like deceptive sellers either. plus, i think stock photos have been frowned upon for a while. pretty good chance you'll get your money back.

You should really dispute it.

Ebay has gotten a lot better. At the very least, I think they'll force the guy to do a return and if he refuses they'll probably refund you themselves.

You might not get all your money back, cause he might pull some bullshit to get you to cover shipping costs. But you'll at least get most your cash back.
