There's a certain line where citing this fallacy wraps around and just becomes an inane way of someone trying to avoid saying "I don't like this, and I'd rather it not exist". A way of trying to make yourself look intelligent so people don't bag on you for your sexual hang ups.

Even the less insane applications of this fallacy are kind of cowardly. You already know the designer just wanted something sexy. If you feel whatever concept that enables excessive fanservice in that universe seems like a cheap and stupid excuse, then just call it how you see it, cheap and stupid. Citing the Thermian Argument and agency is largely redundant and just makes you look scared for having a dissenting opinion. Or that you're just trying to stroke your own ego and holler about how 'woke' you are for pointing out the bleeding obvious that people like making sexy things.
