Not arguing whether they should have broke their agreement. Just wondering what happens to the money. Do they have to pay it back?

Some of these NDAs are huge.
McKayla Maroney got over $1 Million to keep quiet about that gym physician. If anything, I'd imagine these accused would need the money back to fund their legal defenses.

I think that, if what the accused did was a crime, the victim gets to keep it, since the NDA would be void.

However, if it wasn't actually illegal, she's in violation of a legally binding contract, and has to repay it.

Valid point, but then you run into a circular argument with a lot of these cases. Sexual harassment (and even assault) is only criminal if the victim says it is, i.e. lack of consent. If the person takes the money in exchange for saying "oh yeah, that was consensual", you could argue no crime was committed (I don't know if you'd be successful, but the argument could be made).

Plus, while you can't contract to do something illegal, you can't contract to benefit from a crime either. So are the victims guilty of benefiting from the proceeds of a crime when they take the money?
