Somebody was saying that with one of the fcc chairpeople blasting the fcc for their mishandling of the public comments that it opens the door for the fcc to be sued and the decision potentially overturned (basically due to gross incompetence)

I'm rooting for net neutrality, but the theoretical legal case against the FCC is far from a slam-dunk. I'm not aware of any previous cases that are all that similar to the one in development now. I'd love to be wrong about that though... So what legal precedent makes you think that this will be a probable win?

They'd win because:
1. Ajit's Pai's claims about reduction of investments are lies and are easily proven to be lies.
2. The FCC falsified Anti NN comments, stealing identities in the process to do so, and ignored legitimate Pro NN comments. There IS a legal precedent to have FCC votes annulled but you can't even start the process unless a significant show of comments suggests people are opposed to the regulation or deregulation in this case.

It's rather not that we have a right to NN, per se, it's more along the lines of there is a system in place to stop these regulatory bureaus from doing stupid ass shit like this.

We could use more activism on the EPA, though. Internet isn't literally everything that matters. I wish we had this level of fervor when they allowed coal companies to dump waste in the river again.

I said probably. I didn't say it would be a slam-dunk. I'd have to dig to find a case where the FCC was shot down, but the process to shoot them down does actually exist.

That's interesting, I was just curious because while I'd love nothing more than for something like that to happen, I'm not really sure what legal grounds there are for stopping it or repealing the decision once it seemingly inevitably goes through today.
