If the company who made it isn't making any money from it, then what's the harm? So what if a used release doesn't sell that high in the second hand market? Also, IP theft is intangible as long as you're not making money from someone else's IP.

Depends. A ton of stuff that wasn't for sale ended up being for sale eventually.

Something like Thrill Kill I see no moral issues with piracy.

I don't see a moral wrong with "circulating the tapes" for things that are out of print, out of production, and no longer available for sale.
