Sadly, he's right in most cases.

17 states don't protect sexual orientation at all
11 states protect sexual orientation but only in state employment (the majority of employment is private)

Thus, in most cases of employment, LGBT people are not protected in the United States.

A lot of people cared, myself included. Furthermore, the civilian toll of our continued wars in the Middle East hasn't exactly been reduced under Trump, and at any rate that is not what this topic is about.

Ya'll aren't reading the article.

His administration isn't just saying that it's legal, a DOJ lawyer is actively arguing in favor of it in a court case where a man is suing a former employer. What's kind of funny is that a federal agency (the Equal Employment Opportunity Commission) had already sided with the man, so the federal government is on both sides of the case.

So they're playing both sides. :v Too scared to support the gays for fear of losing evangelical support.

I mean, despite the fact that it's weird for the government to technically be playing both sides, it's not that surprising. Sexual orientation is not a protected class in the 14th amendment and there has been no federal act to make sexual discrimination illegal in state workplaces, so it's de-facto legal and it's been up to the states to protect gay people, which many haven't done. So the DOJ argument is actually based on precedent (which has been not to protect LGBT individuals), while the opposition is in the weaker position of trying to change the law. Luckily, the Obergefell marriage decision moved gay people up in the world, so we have more of a chance than we did before then.

With any hope, S.C. will read sexual discrimination into the 14th amendment and stop all this bullshit from happening.

Yet liberals constantly want to let muslims into our country regardless that what they stand for goes against everything they believe.

So the DOJ argument is actually based on precedent (which has been not to protect LGBT individuals),

Read the article tho

But the law has been interpreted to include protections for sexual orientation for decades, after multiple lower level district courts concluded beginning in 2002 that employees could not be fired simply for being gay. The Seventh Circuit Court of Appeals affirmed in April that Title VII does in fact cover sexual orientation, noting that any other interpretation of the law would be "confusing and contradictory."

That's one circuit court, my dude.

https://www.bakerdonelson.com/circuit-split-expansion-of-title-vii-protections-and-sexual-orientation-as-a-subset-of-a-protected-class

Ms. Evans timely appealed the district court's ruling and the U.S. Equal Employment Opportunity Commission (EEOC) filed an amicus curiae brief in support of her position. The EEOC took the position that Ms. Evans presented two cognizable causes of action for discrimination under Title VII based upon her sexual orientation and gender identity/non-conformity.

The Eleventh Circuit disagreed, relying upon its prior opinion holding that Title VII does not prohibit discharge for homosexuality. Evans v. Georgia Regional Hospital, No. 15-15234 (11th Cir. Mar. 10, 2017).

The fact is that most of America doesn't have employment protections for LGBT people in the books. That's just a fact.

The seventh circuit is indicative of a recent CHANGE in the view that title VII does not protect sexual orientation. Courts have long since held that it didn't.
