It seems pretty screwed up for a lot of people. If you go to court for a crime for example the court isn't about finding out what the truth is. It's about the prosecution or defense winning. How that happens doesn't really matter as long as they convince the jury and judge.

No idea what the solution is though.

The defense is about winning.

The prosecution is SUPPOSED to be about finding the truth. But, sometimes you'll have prosecutors, such as the one in the Duke Lacrosse case, that just want to win. Damn evidence that exonerates the defendant.

Yeah that's a factor. Same with people who are lower class/ugly. It's scary to think your reputation can get you convicted in a case that would otherwise have reasonable doubt.

That's because in many cases the truth is unknowable... the system of having to prove the defendant guilty beyond a reasonable doubt makes sense and is the best we can do.

Courts aren't fair because the judges often don't want to work as hard as they should and they tend to often jump to conclusions, which may or may not be the same conclusions they'd reach if they actually took the time to study each case carefully

Obviously this doesn't apply to the supreme court or anything, but for run of the mill cases in front of a trial judge, there's often some very lazy judging

The problem is that I'm not sure every jury really follows 'guilty beyond a reasonable doubt' but more that the prosecution has convinced them that the person is probably guilty.
