Wasn't there just a Supreme Court case about this?
As of at least a couple months ago, yeah. Illegally obtained evidence isn't permissible, and that's a good thing in my book as it nullifies illegal searches and the use of torture.

Law enforcement needs to abide by the same laws as the citizens. You shouldn't need to circumvent the law to get the evidence.

Why cant separate charges be filed for the person that illegally obtained them but still use the footage. Gee man, you cant use the video of me literally committing the crime thus proving 100% i in fact did the crime. Bummer.

The only evidence of Mr.Johnson torturing and murdering your family was the video he literally made doing it. Sorry, we illegally obtained the video. Hes an innocent man.

I've always wondered this: Apparently you can't use illegally obtained evidence to find someone guilty. But what about the reverse? Illegally obtained evidence proves you (the accused/defendant) are innocent. Is that admissible in court?

Does that work in a system where you are "innocent until proven guilty", things like "beyond any reasonable doubt", etc?

I don't see how a situation where illegally obtained evidence that proves someone is innocent would ever occur. An innocent person is likely going to cooperate and provide the evidence.

A man charged with murdering a coworker could be found innocent because there was evidence he was cheating on his wife at another location

This is in place so that the police can't torture you until you "confess." It's there to protect you and justice, not hurt.

-The video isn't yours and someone else is not cooperating.
-You recorded it secretly in a two-party consent state.

This crap is why I'm glad that I'm neither law enforcement nor a murderer.

If the evidence existed, everybody knew it showed the murder, and it was illegally obtained by the police department, could the judge not order its use and then reprimand the police force later?

The families of victims may wish so.
