Did you actually read the article, or just look for a quick line to quote to misrepresent the contents of it?

He was found guilty of violating his parole granted for an earlier crime because he had committed armed robbery in this case by the judge, except he was later found innocent by the jury and thus he DID NOT actually violate his parole by committing the crime, but the judge sent him to prison for it anyway.

This is disgusting, the judge should lose his job and the governor should pardon this man.

After a little more digging what I discovered is that in the state of Georgia the burden of proof for revoking someone's probation is different from a criminal conviction. The judge ruled that while the jury found insufficient evidence for a conviction by criminal standards, the evidence that he most likely did commit the crime was strong enough to warrant revoking probation. That is a very different discussion from saying he dindu nuffin so he should be let go.

Now, I still think he should be free to go, better 10 guilty ones go free than send one innocent person to prison, but this isn't the overstep the Independent article makes it out to be.
