Janitor was taking a fifteen minute break, talking to another employee. I dont know what prompted her to say this, but the other employee said to the janitor in a slightly stern but calm voice "this is my can, and i choose not to recycle. i have that right" The janitor just shot her a reply like "eh, okay sure"

a few minutes later the other associate leaves, and the janitor simply picks up the can and places it in the recycle bin without a smirk on his face or anything. the recycle bin is so close its touching the garbage can as well.

Some people are against the entire concept of the environment, right? I could see if it was something that required any extra effort at all, but this didnt.

It is your right to discard your can in whatever bin you like, but since its trash now it isnt legally yours, thus its now his right to throw it in the other bin.

What is that guy doing as janitor? He should be in management.

Also, if you put it in recycling is it still considered "trash" where anybody can take it and claim it?
