Loitering is a charge that only really happens when you can't come up with something else, but still want a vague justification for immediately relocating undesirables. Homeless and panhandlers get charged with "loitering" all the time.

My bet is that loitering is tacked onto some other charge. This is also what inflates those marijuana statistics reported earlier. Black people are charged with weed possession way more, because they get busted for some other crime and happen to have weed on them, which gets tacked on. Disingenuous studies crying racism for drug arrests never adjust for this.

But you're right, it's nearly impossible to get arrested just for loitering.

People smoking weed here never get arrested, because there are no cops around to arrest them. While in black neighbourhoods there's a lot more cop cars fishing for arrests to make - the same "crime", walking around smoking weed, gets them caught and punished there because there are cops around.

All that means is that we should have even more arrests being made in white communities. The argument I keep seeing from various people is that less blacks should be arrested because proportionate numbers of whites aren't being caught. That doesn't address the fact that all of these people, regardless of color, are violating the law. Stop breaking the God damn law and this will all be a non-issue. Until then... arrest them all.
