I imagine it depends on how you say it
like, they are obviously guilty of being here illegally, so they are criminals
but if they're not breaking any other laws except by being here, and you call them criminals while implying they will cause fights, theft, rape, murder, etc. then you'll get modded

This. Breaking the law is not necessarily a criminal offense. In some states, marijuana has not been legalized, but it is not a crime to possess it. Illegal, but not a crime.
