Yes, Snake and Otacon were originally going to turn themselves in for war crimes and be hanged for it, but Kojima decided it was too depressing and apparently not retconny and silly enough, so he changed it.

I cannot lie. I would have been really pissed at that ending, and I am all for depressing endings. But not Snake, not Otacon, not that way.

Wasn't the story that instead of Kojima thinking it was too depressing the rest of the team basically said "Dude no, that's dumb" or something?

I don't recall what prompted the change. Someone else would be better suited to answer that question.

I have to disagree with what you are implying. Kojima made Metal Gear Solid 3 and 4 only for the reason that the fans were desperate for them ( and for the money i'm sure too, i will not deny that)

He was done with Metal Gear after Sons of Liberty, it's a blessing we got more games out of him.
