18 y/o University of Indiana student, Samuel Elliott is charged with raping a female in a CO-ED dormitory bathroom as she was VOMITING that night from having too much alcohol!!

He turned himself into police and was booked into jail for a single count of rape at an incident that took place at Teter-Thomson residence

The victim who is not being named was initially RELUCTANT to press charges but her friends convinced her to report it including one who found a used condom at the scene.

He was released on January 26th after posting 10% of his 25,000 bail

Documents allege that the University of Indiana students were getting wasted on the 3rd floor on Dec 2, 2011 and after a RA arrived to tell them to leave, they decamped to one of the rooms and continued getting drunk

The girl said she became highly intoxicated after ingesting Pink Whitney Vodka and other alcoholic beverages for 3 hours and ran for the toilet vomiting for quite awhile

She said Elliot then came in and began to touch her inappropriately and then asked her to have sex.

She told him she was far too drunk to consent as she continued throwing up and that's when he dropped his pants and raped her

He later told the girls to keep quiet what happened and walked out. After the victim came out she told them what happened and that's when the friend found and preserved the condom.

For several days the victim resisted going to police because he was her FRIEND but was convinced to finally do it

He is now due back in court on Feb 4
