I really respect that move. Making at least a show of bipartisanship reduces the chances of escalation, even better if the legal experts come up with a solution (and it should be a solution based on legal prudence, not political games)

This is a long game play in a way court packing is not.

They have already used their tools to create a situation that needs rectifying. There is no reason to believe they wouldnt use this power to gain more power anyway. And Democrats doing it lets the court get closer to public opinion, opposed to Republicans moving it farther away from public opinion, which should seemingly play a major part in dictating how the electorate reacts.

But part of the reason they were able to create the current situation is pure dumb luck. Like, yeah, it sucks and needs to be resolved, but I just am not sure a temporary win that is potentially easily reversed in 4 years is a good idea. I honestly don't have a full grasp of what it would mean to allow court packing, though. Perhaps it's possible to place restrictions on it that would prevent obvious abuse, idk.

The Republicans already engaged in court packing. By refusing to hold hearings for Merrick Garland they effectively set the court to 8 jurists. When the field was to their advantage again they packed the court with a 9th jurist.

As much as I hate the political hardball, Republicans have shown they are willing to do anything to hold on to their last remnants of control and power. I am OK with doing anything to reset the playing field.

Odd that no one mentions FDR trying to do the same thing. He tried to expand from 9 judges to 13 and people revolted.

And he did it for the same reason Biden would do it, to pack it.

Biden has a no win choice here.

If he says he's in favor of court packing (which by the way should be a phrase that Dems stop voluntarily using) and be accused of a blatant power grab that not even Trump (seemingly) considered.

If he says he's opposed to court packing, then the libs that are always looking for an excuse to complain will bitch and moan for the next eternity.

This keeps his options open and gives at least a pretext of working within the system either way.

A Constitutional amendment is the only way to solve this. Tie the number of SC justices to something that allows it to increase regularly over time. Also add Supreme Court term limits... and Congressional term limits too if you can.

It's a good thing he's taking this seriously.

Court Packing is a nuclear bomb. Nobody actually wants to use it because it's lasting ramifications could be gigantic. But at the same time, nobody is going to willingly disarm. That's why the Republicans have pushed Biden so much on this. They want him to either commit to an inherently unfavored idea or commit to not using it. Neither is good for the Democrats.
