The lawsuit was dismissed because although it was recognized in court that Nick Sandman was not doing anything wrong, Phelps' assertion that he himself felt threatened and trapped constituted protected speech under the first amendment, despite the judge also acknowledging that Phelps' statement was not really true, classifying what Phelps said as his 'opinion'. Furthermore, the fact that the Washington Post put Phelp's statement into their story, and that Nick Sandman was subjected to harassment on twitter was considered not relevant to the claim of whether or not Nick Sandman was actually defamed. --- Kirbyhameha!!!
