That's news to me. I just got a complaint from one of the people I interviewed because that was one of the questions I asked. Than PR told me I was suppose to ask it this way,"Do you have a reasonable means of transportation to get to work?" I have an idea who complained about it, because he was the only one that answered: "So what, that shouldn't play a factor if I get hired or not."

In my experience, except for those that get dropped off from someone close like their parents/family or bf/gf, those who travel to work through bus, train, or uber have a good track record in coming late to work. We have proof of this, but apparently, it's discriminatory and offensive to ask.

So yeah I agree that I probably chose poor use of words there, but I absolutely think it should be a question to be asked during an interview and should definitely play a role in one of the criterias for hiring.

We all make mistakes, just make sure you learn from them. I don't think it is considered illegal by law because it isn't one of the protected statuses, but it can lead to candidates feeling that is the sole reason they didn't get the job rather than a combination of that plus other things.

with that attitude imagine what kind of a worker he'd be. sounds like trouble. i would have asked one more question and gave him the generic "well we're still looking at a couple more people" spiel and then placed his resume in the shredder.

Wow. Okay imagine if this isnt the persons first experience with this. What if its a good candidate that has had many successful interviews and the one thing that keeps screwing him is the lack of a car? Yeah, it is a frustrating roadblock and if you dont have a job, you cant get a car. But if you cant get a job because you dont have a car.... see where Im going with this?
My roommate is now a manager at where she works, but three years ago she was told by the Gm when he found out she didnt have a car, if he was legally allowed to ask that during the interview, he never would have hired her. She now has a car and everything is Gucci but there is a reason you cant ask that.
Its lame if people are late, obviously its not preferred. But remember when you are hiring, these are people. Sure your interest is the company, but maybe this will be the stepping stone they need to get the car and not be late ever again.

I guess they could try to stretch it and say that you were using financial information to discriminate against them if they weren't hired, but people can try to state discrimination about anything if they weren't hired. For my company, we only ask if they have a driver's license if they are transporting things. Like if the person is going from one place to another, then technically they could ride transit, they don't necessarily have to drive. Use a better question like what someone already stated with the "do you have a reliable..." Meh, not that bad of a thing though that you did.

Honestly, it's not even about him not having a car. It's the shite attitude he had. If he's dedicated to the job and insists on taking the bus everyday more power to you as long as you're on time. But I don't need that bad juju running around my department.

I have a hard time believing either question is illegal. Car-less people arent a protected class. Ill gladly change my mind if anyone can show proof that asking it the way tc did is illegal.

Its discriminatory, but the entire purpose of the interview process is to be discriminatory.

Why do people keep bringing up protected classes? Apparently, I was wrong. It's typically illegal, because it's financial informaton.
