That's a weird case. The shooter's friend stabbed the guy with the gun before he pulled it out.

Me, too. The 32-yo's gf (?) stabbed the 36-yo after somebody started an argument. The older guy pulls out his gun (in self-defense?) only to be disarmed and shot 4 times at point-blank range, on top of having been stabbed twice.

Sounds to me like charges should be filed against everyone.

Why was that passenger shouting for the door to be closed?

It sounds like the 36-year-old was looking for trouble having a knife and gun and was the aggressor.

Thought I did.

Older guy jumps a turnstiles, ends up on a train with younger guy and yg's gf. Argument ensues over a seat, and gf gets a hold of og's knife somehow, and stabs og during the argument. Over a subway seat.

In response to being stabbed, og pulls his gun.

Gun gets taken by yg who puts 4 in og's face at point blank range.

Which part did I miss? I swear I read it before replying.

Yeah, he's the one pulling out weapons and being the aggressor. Using them against him is defense.

First person to attack isn't necessarily the aggressor. If you're making a credible enough threat, being to first to actually attack can still be considered self-defense.

That being said, on reread, there's really not much detail to his "being the aggressor." It literally just says that he was, indeed, the aggressor.

His back was turned though so he was walking away, then gets stabbed twice. That could effect the self defense on the stabbing part.

Him and the woman that apparently stabbed him before he drew any weapons, in the back.
The only person who wasn't arrested or in the hospital...

Glad the 32 year old isn't being charged, when someone pulls a gun on an unarmed person, it's absolutely self-defense to disarm it and use it yourself, on him.

Are you sure it looks like he had the guy holding him down and punching him till the guy's girlfriend stabbed him in the back where he shrugged it off saying "You stab me" while going for his gun, which the bf quickly took from him and shot him in the head. Also before that, it was Verbal till it became a fistfight.
