Some states the legal limit is stupidly low, literally one or two drinks can get you arrested. I believe in Spider-Man rules, "everybody gets one" within reason. If someone is like 2x or more over the limit, fuck em, straight to jail with a felony charge.

Drinking and driving is an outrageously selfish, dangerous and stupid thing for any person to do. Anyone who does it is actively endangering themselves and everyone around them. It is absolutely something that should be taken with extreme seriousness.

With all that being said, felonies are life changing. They impact one's ability to live a normal life and disenfranchise people in many states. So I'm really hesitant on what I think should and shouldn't be a felony. I think that your first DUI, so long as no one get hurt, shouldn't rise to a felony. I think it should require substantial substance abuse treatment, a requirement breathalyzer to start a car, and random alcohol screenings for a year afterwards. I think failure to comply should elevate the offense to a felony. But initially, I think people should have a way back from a mistake, even a big stupid one.

If someone gets hurt or you get a second DUI, it's not just a felony. You are never driving an automobile ever again.

I have 2 I think if I get another one its an automatic felony and my license is gone for a really long time I know if you hit somebody its an automatic felony. Also i think its a time frame thing too mine where 5 yrs apart if it was within 5 it wouldve been a lot worse of a punishment

The limit is .08 in every state but Itah, where it is .05

I'm just calling out your pearl clutching. Someone having a drink at a restaurant or with friends 99.9% of the time =/= drunk and they don't deserve to have their lives ruined by laughably low BA levels. That said, the onus is on the drinker to know their body and if one drink is going to effect their reflexes and decision making. You can even buy tests to take yourself to be sure you're under the limit. There's no excuse for drunk driving, but let's not pretend driving after one or two drinks and giving it an hour since rhe last one = OMG DRUNK DRIVER!!!

It is enough to affect their reaction times and decision making. You don't trust the person to make that call because by definition they're not thinking clearly. "Let the drunk guy decide how drunk he is" is one of the stupidest suggestions you could make.

Don't drink and drive. It doesn't get any simpler than that. If you drink, you don't drive. If you do, you deserve to get arrested. Period.

That isn't at all what I said, calm down. Most people know what their tolerance is; for me I know 2 drinks might put me over the limit and I'm not comfortable driving even if I am under the limit as I rarely drink. My 300lb 6'5 friend who can crush a 6 pack would still be barely under the limit due to his metabolism and regular drinking habit.

Well even the law disagrees with you and the tolerance on average is 2 drinks. Is it a great idea? Probably not. There should be some consequences, yes, But again, I don't think someone deserves to have a literal fucking felony and their entire life ruined for one lapse of judgment when they were right on the line. Do it again, fuck em, throw the book at them. Again, that's very different from someone downing a half bottle of Jack and choosing to drive anyway.

This but also lol at the pearl clutches claiming 1 drink means you're wasted beyond repair and should never drive again or w/e they're on about. 1 beer or glass of wine, or hell even a shot, over the course of a meal isn't enough to impair *anyone* unless they have a medical condition. If you tie one on with your buds during happy hour but stop drinking a few hours before you leave you'll process out enough alcohol to pass a breath test. Just be smart

I agree, it's not a great idea, however the law does allow for tolerances and knowing MOST people will be fine if they have one or even two drinks while out. A .05% is literally one or two drinks for most people. A felony for that is a bit much especially considering how overpopulated our prison system already is. Community service, probation, a fine and a week in jail would get most people's attention
