We had one that I joked about. Guy had 7 counts of dui but he was a literal midget so I joked he just couldn't see over the steering wheel. But alas he openly admitted he loved to drive drunk.

Oh yeah. He definitely needs to be locked up. And probably for life. Without having actually hurting anyone though I'd say stick him in minimum custody. But I always found it odd they do have separate prisons for white collar criminals but those are really the only ones who get separated.

If anything violent and non violent is what should be separated.

By the 9th offense he doesn't deserve any sort of treatment. That's not the state's responsibility at that point.

Nah it actually annoys me I know some inmates with like 80 years and it still doesn't say life on their sentence. If they gonna die in prison may as well call it life.

At that point he's clearly shown he doesn't respond to legal penalties and will keep endangering people. A life sentence is appropriate.

The fact that you can get around a car breathalizer is kinda irrelevant. People can get around a lot of things. But it does make it harder and it also adds an entirely new layer of forethought to the action.

Like the average person goes out with some friends to watch a game, has a couple of beers. When they leave, they blow to start the car and whoops, they blew a 0.09. That person is probably not going to game the system. They'll call an Uber/friend or just wait it off. Most people aren't looking to drive drunk, they just underestimate how drunk they are and will stop attempting once they realize that they are over the limit.

Now if someone is bypassing their breathalyzer to drive while impaired, then they are a serious problem and when caught need to face considerably stronger penalties. Because they are operating with active intent to harm.

I'm assuming things where tried. At the very least urged to go to rehab for a lighter sentence. To be honest rehab kinda felt like a minimum custody prison.

Strike 2, 5 years and 10 year suspension.

Strike 3, life. No parole.

Pretty excessive but then again you can kill as many people as you want in Canada and not get sentence any higher then life, 25 years parole.

You also should keep in mind some people get dui by drinking the night before and not having the alcohol out of there system the next day. Would you consider that worth being put in jail for a year with a 5 year driving ban?

I think license suspensions, at least for first offenses, are not terribly practical. Like if obeying the suspension means you lose your livelyhood, then basically everyone will drive on a suspended license. So it doesn't actually keep people off the road. And the people most likely to repeatedly offend, will keep offending. But because the license is suspended, they won't put breathalizers on your cars because you theoretically shouldn't be driving. I think it would be better to do a mandated breathalizer on a car and have your license on probation so that any further driving infractions have increased punishments. That would do a better job of preventing the people most likely to repeat offend from doing so, while also not financially ruining people who are one-offs.

That would work, but I'll be blunt, I just don't like the idea of financially ruining people on first offenses for most crimes.

The justice system should balance 3 things, protecting the populace, rehabilitating the offender, and punishing the offender. For most crimes, especially first offenses, I think the first two things should be priority over the third.

I get the same response from smokers. My mother has stage 4 cancer, and I was a caretaker with someone with late stage copd. She had pnumonia 14 times lifetime and 10 times in the last 4 years. She died last year It's horrible to see die over something that's totally preventable. Beat the addictions. It's clearly this guys problem. If you drink stay the fuck home. If you are getting DWIs know your fucking limit. All preventable shit.
