There are people that can't tell the difference between a 14 year old and a 17 year old?

I had to start wearing bras when I was 12. I had classmates who looked like they were 15 or 16, but were actually 13 and 14. It depends on the person I guess.

No. This isn't the first time I've heard of this happening. I remember one case where the guy was something like 30 and the girl lied about her age.

What should happen is all charges get automatically dropped in cases like that.

This sucks but I don't see how the law can be changed to account for it. Actual predators would just lie about not knowing the girl's real age.

Solution is not to have sex with people you haven't gotten to know.

There's gotta be a way to word these laws that protects innocent people, while still punishing the actual predators.

Because doing a deep dive on this stuff brings up tons of cases where even minors are charged for sex crimes and it's absolute stupidity. Things like:

In Fayetteville, North Carolina, a sixteen-year-old girl faced multiple felony charges for sexting a picture of herself to her boyfriend. According to the county sheriffs warrant, she was both the adult perpetrator of the crime at handsexual exploitation of a minorand its child victim. Her boyfriend faced similar charges.

How do prosecutors look at something like that and feel that it makes sense?

Apparently Canada allow "mistake of age defense as long as the accused took reasonable steps to validate someone's age" whatever that means. But I assume chats, id or meeting in a bar are stuff that matter to this. I guess putting the onus on the defendant is the key

Most areas have something called the "romeo and Juliet law" to avoid stupid cases like that, but I think it does not apply to pictures

I'm torn about this one. She said she was 17 which is still a minor. In my state it's still very much illegal for a 19 year old to have sex with a 17 year old

Oh oof, I dont know about today but I definitely would be making sure a girl was of age if it was on that app. Back when I used it probably a decade ago... it was very obviously had many underage girls. It didnt really seem strictly a dating app because the premise was kinda of "do you think this indivdual is attractive or not?" Then youd get rating. It was kind of was used to feed your ego.

I do still think that if its a app strictly for adults then you shouldnt be punished like this guy was, though not sure if HON has an age restriction.

So I was looking into the legal definition and found this:

It's a short read but the relevant part to this topic is

Furthermore, because many rapes are facilitated by drugs or alcohol, the new definition recognizes that a victim can be incapacitated and thus unable to consent because of ingestion of drugs or alcohol. Similarly, a victim may be legally incapable of consent because of age. The ability of the victim to give consent must be determined in accordance with individual state statutes.

So my take on that statement is basically "the minor is never in the wrong" which sounds good on paper but as we see here it is still abusable. Not gonna deep dive into what each state defines as consent but the one in question sounds like it aligns with the FBI's. Not that the judge in this cares about legality, or rape even. He just wanted to flex his viewpoints because he can.

My guess is that some people worry that it might be abused if we let it go. But tbh considering the fact that he asked her age on the website, it's actually usually easy to verify if it's a lie or not

They probably should put a disclaimer. Don't forget that when we were younger, scandals like that were not known and people were more likely to believe they were telling the truth
