Tbf, this is also not how the courts work. It's not "is there a rule that blocks it", it's "is there a good enough reason to break the rule", which it has been blatantly proven that there is.

False. Please take this rhetoric someplace else, because I'm extremely disinterested in your input right now.
How long do you think itll be before you get suspended again for saying that you dont see what was wrong with 1/6?

You have terrible opinions that will lead to people getting killed from a preventable disease and is currently stressing our medical infrastructure to insane degrees. You should own that.

his confirmation (or lack thereof) was a pretty clear violation of the senate's constitutional duty of advice and consent.
I don't think it's completely fair that he never got a vote, but ultimately it's the majority leader's decision when and how these things occur. Parties get more or less control over these processes based on how elections go, so ultimately if McConnell was the majority leader, it's because his party holds more senate seats.

It all comes back to the fact that elections decide how these things shake out. The justices themselves are unelected, but they are nominated by and confirmed by people who are elected.

I've never said this before in my life. I have always said that 1/6 was an occurrence of mass criminal behavior and that those who committed crimes that day should be appropriately penalized.

Whatever it is you think I've said about it is most likely what you would expect me to say, based on whatever imaginary version of me exists in your head.

And now we circle back to the supreme court's perception as an apolitical body. Not, as you implied, because all nine of its members are meant to be utterly neutral, apolitical figures. But because they are supposed to be somewhat removed from the usual political power plays of the other branches.

You fail to understand what a disgusting blow to democracy McConnell dealt with his decision, and playing it off as "elections have consequences" just shows how far the court has fallen that you think this behavior is normal and/or in any way justified.

The nomination process has always been political. Kavanaugh got raked over the coals, and so did Clarence Thomas back in his day. There has been political buffoonery in the appointment of Justices for decades at the very least, but once they're on the bench, they're not bound to any political party and they never have to worry about "running for office," so there's really no incentive for a justice to vote in any way but with their own reasoning.

Late to the party, but the Bloodborne Pathogens Standard stomps the fuck out of this ruling. Or would in a just world.

Which in short, gave OSHA the power to regulate businesses to establish prevention of transmission of illnesses that could be transmitted by exposure to blood.

And that's with any place where workers would could be reasonably likely to find the presence of blood, including healthcare, food service, janitorial work, as well as for anyone who is trained in administering first aid in ANY occupational setting.

There's absolutely precedence for regulating for transmissible illnesses as a matter of health of a workforce.

And COVID is a pretty fucking transmissible illness.

The standard was honestly super tame, too. I don't know if anyone has reminded the topic of the details, but it's basically establishing vaccination tracking and testing tracking and offering for people who don't want to or can't vaccinate.

I could set you up with all of that in a day in my line of work.

thank you for the response. I missed your comment the first time.

from my quick read of the court's decision, unfortunately OSHA did not mandate businesses with potential exposure to blood. they mandated businesses with 100 people. probably because that was intended by Joe Biden to be far more impactful.

There's a easy fix. Just put the voluntarily unvaxxed at the absolute bottom of the priority list. If someone who is voluntarily unvaxxed and has covid has lung issues and has been waiting for a week to get it checked out, and someone else walks in off the street with a stubbed toe, that person who just walked in should be treated as a higher priority than someone who is voluntarily unvaxxed. And the only way for the unvaxxed to then get treatment is for all other people seeking medical attention to have been dealt with. If that means they have to wait 9 months for treatment, that was their choice
