That isnt the problem To avoid a misunderstanding - what I was implying is that punching and abusing a person might definitionally not count as 'assault' but certainly would count as 'battery' and by charging as assault they might have been able to get the charges dismissed because assault and battery aren't the same thing so by charging as assault instead of battery they got off instead of going to trial. --- "Salt cures Everything!"
