And hey, some folks at work, myself included, dont have to rely on a pension either. Shocker, I know. And that means 401k(and savings, stocks, etc.) is all we need. This particular instance has never been tested in court (b/c...how crazy is it to have a criminal in the White House, using his job status to shield him from legal consequences?), but in similar situations where a criminal evaded detection/apprehension during the SOL phase, judges have ruled that time effectively "suspended" the "clock."
