I understand asking it or even saying she wants to but she didn't even ask, we saw it on the lab results. I think it's fucking ridiculous since we didn't ask for it and that she didn't say anything at all about it. What should we do?

Sounds like she was just trying to drum up extra lab costs for the insurance company, but then, I haven't been in your situation, so I'm not sure if it's "normal."

Yeah sorry I mean during her initial blood screen during her first pregnancy visit.

Alright I wasn't sure it was standard. I was looking online and read that it was mostly optional.

I had a family go ballistic on me when I ordered a pregnancy test on an 18 year old with abdominal pain and menstrual irregularities.

I know your holy virgin daughter hasn't even been introduced to the concept of sex, but most have by that age, so deal with it.

Some of it (whether or not its mandatory) likely depends on state law, but it is standard practice to obtain some type of drug screen during pregnancy even if its just verbal. personally i tend to tell my patients what Im ordering.

Im sure @MrPeppers could confirm since i dont do much OB counseling

I can tell you though that if they have suspicion and you refused, they would just test your baby after birth, which technically they dont need consent for

TL;DR: Hire a lawyer.

The United States Supreme Court has ruled that hospital workers cannot test pregnant women for use of illegal drugs without their informed consent or a valid warrant if the purpose is to alert the police to a potential crime.

another topic with fucking snobby ignorantly blatantly wrong answers from the fine citizens of CE.

The purpose of drug testing is for the safety of the baby, to warn parents of potential teratogenic/ birth defects from drug use, for the OB team caring for the mother, and so that the baby can be appropriately triaged after birth if concerns will be present for withdrawal, etc.

Regardless reporting results of the UDS to the police is a clear violation of HIPAA.

Good job not sounding snobby or ignorant though

there is only one interpretation. they can drug test her for the benefit of the potential child and to make sure there won't be any complications...if they take those results to the police they'll have broken the law. you REALLY don't think its important for a doctor to know what type of potentially harmful substances their patients have ingested? what substances the fetus/baby may have been exposed to? the ONLY reason for it, in your eyes, is to get them arrested? Come on, dude.

I mean, a doctor could probably find out a lot about someone's health by checking their search history too. And they don't do that. I absolutely don't think it's OK for a doctor to steal that information from you WITHOUT YOUR CONSENT. TC should make sure he didn't sign something ahead of time that gave them consent.

I really don't want to have to explain something so obvious, but I guess you leave me no choice.

If the labs you're ordering for an individual are directly related to medical decision making, and the individual has the right to refuse them, you don't have to literally explain every lab you order, unless you love hearing about lipase, HgbA1C and whatnot.

I know people lose their shit over the right to (not) be drug tested, but a UDS isn't meant to send you to jail, it's to guide proper medical decision making, the consent of which is implied by the fact that you willingly stuck out your arm to give blood.

The doctor isn't going to call the cops jfc.

You consent to every blood test possible every time you hand over blood? I really don't think that's right. Financially for one thing, it doesn't make sense. I definitely believe that you and other docs gloss over the consent process though because no one cares enough.

Everyone thinks pregnant women don't have rights. That's why they all just universally tell them not to have alcohol and shame them if they do. Despite the actual evidence saying about a glass of wine per day does nothing to the baby. But why give pregnant women choices like that? They can go back to making their own decisions when they aren't pregnant.
