President Trump's Supreme Court nominee argued last year that net neutrality rules violate the First Amendment rights of Internet service providers by preventing them from "exercising editorial control" over Internet content.

Trump's pick is Brett Kavanaugh, a judge on the US Court of Appeals for the District of Columbia Circuit. The DC Circuit twice upheld the net neutrality rules passed by the Federal Communications Commission under former Chairman Tom Wheeler, despite Kavanaugh's dissent. (In another tech-related case, Kavanaugh ruled that the National Security Agency's bulk collection of telephone metadata is legal.)

While current FCC Chairman Ajit Pai eliminated the net neutrality rules, Kavanaugh could help restrict the FCC's authority to regulate Internet providers as a member of the Supreme Court. Broadband industry lobby groups have continued to seek Supreme Court review of the legality of Wheeler's net neutrality rules even after Pai's repeal.

There's a difference between discontinuing DNS service when there are plentiful competitors who would like Spencer's business, and preventing end users from being able to access web sites that they ostensibly pay to access

Until ISPs start inserting contract clauses that say something along the lines of "we reserve the right to present to you any subset of the Internet that we like, and therefore block what we don't like, because First Amendment", it's not a valid comparison

(and when that day comes, we've got some serious thinking to do about how we approach our relationships with ISPs)

Who's to say Trump won't make ISP's "exercise editorial control" to block news websites that report negative news stories about government officials, or websites run by people that oppose a bill that the government is trying to enact into law?

This is the type of thing that you'd see in China, Cuba, North Korea, and the former Soviet Union. As someone whose father experienced one of these communist countries first-hand and was able to escape to a better life, developments like this happening in the US absolutely terrify me and my family. We know where this usually leads.
