It's not like they hacked into the content owners bank and transferred out $50 or whatever the price of the video is. The content owner will wake up the next day with exactly what they had the previous day. They have lost nothing.

Those two situations are completely different. Piracy results in no loss. Obviously if you steal someones possession, they lose that possession. That's a loss. The content owner has lost nothing in a piracy incident.

and the law classifies them as separate crimes with different penalties for this very reason.
