A Georgia Jury has awarded an eye popping 1 BILLION verdict against a security company because of an employee of theirs was convicted of raping a 14 y/o girl!!

Hope Cheston was outside some picnic tables with her boyfriend during a party in 2012 when an armed security guard approached and told the boyfriend not to move and raped Hope!!

The guard, identified as Brandon Lamar Zachary was convicted of stat rape and is serving a 20 year prison sentence

The mother, Renatta Cheston Thornton filed the lawsuit on behalf of her daughter as the jury handed down the verdict against Crime Prevention AGency

Zachary was 22 at the time as she said he should have never been hired because he wasn't licensed to be an armed guard

The judge already determined the company was liable so the jury determined the damages..which they came up with the 1 billion figure!!

Minors who were raped aren't normally identified by Hope gave her permission to be identified and is now 20 and a full time college student who works with an organization that helps homeless people.

She says a lot of women who suffer sexual assault don't pursue justice, choosing to instead put it behind them but she wanted to show that people do care about the worth of a woman

The prosecutor was shocked by the number as there is no basis in the legal world for how high a rape verdict can be as verdicts in the tens of millions of dollars or even hundreds of millions are not uncommon but a billion for a single victim is unheard of

Yes because of that line. The amount is ridiculous, though. That's a good way to make sure the victim never sees any money or a vastly reduced amount.

Company didn't make sure the guy had his licenses in order and he used his position to rape a woman and threaten another. So yes, this seems reasonable since the company didn't fulfill their basic obligations to make sure the guy was even legally able to work for them.

Odd that he was convicted of statutory rape rather than rape unless they really didn't think they could demonstrate that it was forcible. (And yes, the normal use of the term "statutory rape" means the victim was willing but not legally able to consent. In Georgia, willingness is irrelevant but it's still a lesser charge.)

It's reasonable to find them liable, but to say that the billion dollar jusgement is reasonable is flat out incorrect.

According to OP, the Jury decided how much the company has to pay. So I don't see how it's the judges fault.

I think the company being responsible is fair in this case. Security is definitely a professional where employees need to be thoroughly vetted and customers need to be able to have a very high level of trust.

With that being said, one billion is ridiculously excessive.

Is that legal? That doesn't sound like proper judicial process.

Yes the company should be responsible, but the amount is way over the top. When I was on a jury case that involved a death from 4 different families we did somewhere around 2 million a piece.
