it doesnt just matter whether you give a jury the option of a lesser included offense, like manslaughter. It matters how you argue it to the jury. It sure seems to me that there was a good argument for manslaughter here. But did the prosecutor press that home? I wasnt there, but it would not surprise me if they didnt.

The reason is strategic. Prosecutors often choose the level of offense they want and argue hard for that and de-emphasize the arguments for the other levels out of concern that a jury will convict of a lesser included because its simpler to decide

So it would not surprise me at all if the prosecutor didnt really forcefully and in detail make the even if it was accidental it was manslaughter argument, out of fear it would encourage the jury to choose that instead of murder

No chance he would have gotten 2nd. Voluntary manslaughter was the only possible conviction. They deliberated for days. It's complete bullshit that jury didn't think "well you know, this one charge says it could have been involuntary". Of course they went over that.

Actually it's not. Very few states have it even as a felony. Look up Shannon's law. Arizone had passed a law to make it a felony to fire randomly into the air after a middle schooler was killed by someone doing just that. He was charged with just a misdemeanor. Why do you assert things you obviously know nothing about? And yes, he was charged with 1st degree, 2nd degree and manslaughter. You don't even know the difference between charged and convicted. Come on man.

He was charged on first, second and manslaughter. Again, disregard for human life is not 2nd degree murder. Murder is always in some way intentional. That's what makes it murder.
