So, for people that don't know, I live in a house that is recording what I say and do. I was not made aware of this until about two months after I moved in, and the household's wife threatened me with litigation over something I said that I thought was in private.

Now, I'm so stressed and paranoid that I have taken to actually video record, from my phone, my entire room tonight and will do so again when I move out. I'm doing this because I do believe the landlords have planted evidence of drug use in the room my mom was occupying after she moved everything out later today. When they notified me of what they allegedly 'found', I waited until they went to bed and began filming.

I showed under my mattress, under the bed itself, in the closet, my desk, literally every nook and cranny. And I plan on doing another video recording on the day I move out. This is how fucking awful these people are, and just how serious this has gotten. Now, the husband's brother is moving into the house on the day he'll be released from prison (which will be in about five hours time). I feel threatened, I feel scared, and I'm desperately trying to find a place that will put me up so I can get the fuck out of this house and away from these... 'people'

In the state of North Carolina, it's legal for the landlords of a home to set up cameras and recording equipment without telling another party. It's okay so long as one party is privy to the existence of said devices.

Agreed, which is why I'm trying my fucking hardest to find a place by the first.

The wife showed me the cameras in early July after confronting me first with threat of litigation. I wish this was paranoid delusions, but I'm absolutely serious. These people are the type to burn down their house for some small problem. The officer that was called on the day my mom was forced to leave explained to us that this was standard for the people we're renting from. They've been in trouble and involved with the law many, many times.

I wish it wasn't, but low and behold it absolutely is in the state of North Carolina. Now, whether or not the threat of litigation could amount to blackmail is another story, but quite honestly I really just want to get the fuck out of this house.

I'm no lawyer but I don't see how this could be legal. How did you get this info? Have you talked to a lawyer?

I mean.... I imagine you've been naked in your bedroom before. It would be illegal as shit to record that without your permission.

right?
audio, maybe. but it's still seems like landlords should be under different standards than recording a phone call.

video? no fucking way.

Don't the recording laws only take effect in public settings, or when meeting with people in private? I don't think it actually counts if they put a spy camera un your apartment without letting you know(or at all really). You might wanna check into it more, but I'm pretty sure even lax recording laws don't allow them to watch you in your own home.

What did you say that they wanted to sue you over?

I mentioned to my mom in the kitchen, while the couple were out of the house, that, and I quote, "if he hits me he better make sure I stay down, or else I'll kill him." Because I perceived what I thought were passive aggressive behaviors towards me from him, and I assumed he had issues with me. The wife mistook me for saying that I would put a hit out on the guy, and then confronted me while drunk about it and threatened to call her detective friend on me.

TheBiggerWiggle posted...

Again, the wife indirectly admitted to her filming and recording me the night she got drunk and harassed me over it. When I put two and two together she actually pointed out the locations of the cameras and then called her detective. I don't know if she actually did this, but she certainly put on airs like she did. She threatened me with jail if my mom didn't leave that evening, as my mom was the one getting super upset and I just kinda took everything in.

In the state of North Carolina, only one party has to be privy to the existence of cameras in the home. When renting a room from said landlords in their place, only bathrooms and bedrooms are considered private and off limit territory for surveillance cameras; all other areas - kitchen, living room, den, etc. is considered public and is legal and lawful area for the landlords to set up and monitor.

Holy shit, that's absolutely fucked up and I hate that you have to go through this. They just forced your mom to move out on a moment's notice because a drunk homeowner upset her?

No, she calmed down and I guess saw how completely shot I looked emotionally and I guess took pity? But basically, her and my mom have never seen eye to eye and about once a month would get into an argument. Eventually she was forced out and, even though her rent was paid through to the end of this month, they said that she had 48 hours to get her things or else she'd be trespassing.

You need to get help from housing authorities in your area. Get out of there and then at least get the rent back.

If your mom was on the lease, they fucked up. But if not, then you can at least get the money back through small claims.

She was on the lease, I'm hoping she still has the signed letter they typed for her that stated she wasn't allowed back on property.
