The ruling states that in this case there is no clear evidence that these particular school employees were in what would be considered "positions of power or authority" over the legal-aged students they had sex with. One of them wasn't even a teacher. If an 18yo has sex with a teacher, but she's not in that teacher's class, then that teacher doesn't really have any authority over her. They can't change her grades, or give her extra leniency or preferential treatment. There's essentially no advantage for that student to gain from the relationship, nor leverage the teacher can use to manipulate the student into sex. It's still a felony for a teacher to have sex with a student in one of their classes. Or a principle to have sex with any student in his school. By that logic, any teacher having an affair with a student could request the student be removed from their class, and problem solved. I think they consider any authority figure within the school to have "power" over anyone in the student body. Sure, but in this case the judge claimed that that "authoritative power" was not proven to be there. So basically it was just two legal-aged adults having sex.
