Either you don't know what first degree murder is or you think second degree murder is the same as manslaughter

If someone in a bar says something that pisses you off and you react by saying "I'm going to kill you" and then killing them that is not premeditation. That would be a crime of passion.

If you went to that bar with the intent to kill the person and then said "I'm going to kill you" and did so that is premeditation.

We don't know for sure which this is.

They need proof that the murder was planned before the encounter started.

Corrik, a situation happened and people say things in the heat of the moment before carrying things out often. That's not premeditated murder.

If say they found texts or stuff between the girls days or weeks before hand stating what they were going to do or laying out a plan then it would be 1st degree murder.

As an example...

You find out someone is cheating on you, you threaten to kill them and then you do.

Now if the person sat around planning to kill the person then it would be 1st degree, if not then it's 2nd degree. With that said 1st degree murder is hard to prove in court.

Crime of passion can also refer to people committing a crime where emotions played a huge role in their crime. Like if a person who was never prone to violence found his wife in bed with another man, yelled out "I'm going to beat you ", then proceeds to beat the person and severely hurt him.

1. His emotions played a role here and can be argued that they played some role in his decision making

2. Did he plan on coming home and finding his wife in bed with another man? If he screams "I'm going to beat you" Then does so is it premeditated?

Also in Canada the maximum penalty for 2nd degree murder is the same for 1st degree.

The moment torture comes into play it's first degree. You have to purposefully inflict that pain on an individual and for a while, I don't care if they're not right in the head or not, that's for people qualified to decide where they end up. Corrik premeditation requires time and a sound state of mind. If you charged them with 1st degree all their lawyer would have to do is say a fight started and things escalated from there.
