That would be a crime of passion. If you went to that bar with the intent to kill the person and then said "I'm going to kill you" and did so that is premeditation. I don't understand why they are being charged with second degree and not first degree. The recent trend of these types of things getting live streamed is pretty disgusting though. Saying you are going to kill someone then stomping their face in while the victim says they are sorry and is choking on their own blood and then after she dies hitting her with a foreign object repeatedly. Then trying to obstruct justice by trying to tell people to lie abour what happened. Not 1st degree my ass. None of that shows premeditation and if that is what the state requires for first degree then that is really all there is to it. Do the deserve the harshest penalty possible? Yes. Can you just charge them with something you don't yet have the evidence for? No. Saying I am going to kill someone prior to killing them is premeditation. Stating otherwise is just silly. Corrik premeditation requires time and a sound state of mind.
