But because the higher ups at federal agencies are TERRIFIED of this kind of thing. So terrified that they'll refuse to make necessary arguments in order to avoid the possibility of this happening and refuse to go out on a limb under any circumstances. And lawyers/government people are already typically a cautious bunch by nature.
