The EEOC could lose due to a lack of evidence or a bad judge, but blanket criminal records bans are known to have an unjustified and illegal disparate impact based on race. It has to be a crime that's relatively recent, and relevant to the specific job. The policy can't be overbroad. This isn't just in employment, it's also in housing and other relevant civil rights laws.
