On Monday, October 2, 2023, the United States Supreme Court rejected a request to block Donald Trumps 2024 presidential candidacy. The request, based on accusations of incitement to riot on January 6, 2021, was filed by Texas State tax consultant John Anthony Castro.

The justices denied the lawsuit, saying there was no standing to disqualify Trumps candidacy under the third section of the 14th Amendment to the U.S.Constitution.

This section prohibits anyone who has participated in rebellions, insurrections, or aided or supported enemies from holding federal or state office.

Castro argued that Trump encouraged his supporters to storm the Capitol. On August 1, Trump was indicted for the invasion of the Capitol, being accused of conspiring to remain president despite his defeat in the 2020 elections, won by Joe Biden. Trump has pleaded not guilty to all charges. The US Constitution does not prevent convicted people from running for president, but the scenario is uncertain if Trump is arrested. The Republican has already been indicted in two other cases.
