No. You're incorrect and have not been following these stories closely enough. The relevant charge is "willful retention." Pence and others, upon finding classified documents in the wrong place, immediately reported them and then invited agencies to go through various locations to look for more. He did not "willfully retain" the documents. Accidentally having classified documentation in the wrong area is not a crime; knowingly keeping it or hiding it or spreading it around is.

Compare: they have RECORDINGS of Trump WAVING THESE DOCUMENTS IN PEOPLE'S FACES GOING "Look at this! This is top secret lmao!" When it was discovered he had hoarded these documents and willingly shared them with people, he TRIED TO RETAIN AND HIDE THEM. There is suspicion that he was SELLING THEM TO FOREIGN AGENTS especially because documents are STILL MISSING, meaning he is at best STILL WILLFULLY RETAINING THEM, and at worst, he GAVE THEM AWAY.

^ He knew they were classified, admitted it on tape, and still did not return them and made attempts to retain/hide them further. We're talking about hundreds of documents, many of which were related to the military/security, that he stuffed in his international party house. Don't be such a fucking tool. Everyone and their mother knows what he was doing/planning to do with these documents.
