Except it's not. The feature literally exists to prevent governments from continually trying a person until they get a conviction and making a mockery of the system. It was always known that some guilty people would go free in order to prevent rampant abuse within the system that would lock up countless innocent people and remove any justice from the justice system.

The thing is the US has an actual flaw in the system that could be used to punish him down the road, namely the fact that if he's charged with another crime people may use that opportunity to punish him for something he previously did. Kind of like how they didn't get OJ the first time, but he went to prison for taking back his stuff which he might not have done if he didn't get away with murder earlier.
Except this proves that abuse of the system is already happening anyways? So it would make sense to allow exceptions?
