There doesn't need to be an identical case that's set precedent. If that was the case, we'd never have any cases.

The way the Civil Rights Act is laid out, forcing an employee into a religious activity would be a blatant disregard for their protected rights of religion. The employer could have said that all people, even if they aren't religious, would be forced to join. But that also violates the Act because an employer should not be asking about that.

Discrimination doesn't have to just be about not allowing someone in. In this specific case, the discrimination is putting the employee into an uncomfortable position of forced-joining in when it falls under the protected case of religion.
