Read about it. As long as he is an employee and the place has more than 15 employees that's an open a shut law suit for this guy.

Hopefully he takes everything they have for being such shitty people.

I mean obviously it's illegal to discriminate based on religion. Bit the sticky part is he clearly says you don't have to believe in god, you just have to participate in their prayer.

I see how that's really walking the line but seems like something a somewhat competent lawyer could easily finagle around

It's been tried before and failed because it ignores the religious rights of people who might not be able to pray with others, etc.

There doesn't need to be an identical case that's set precedent. If that was the case, we'd never have any cases.

The way the Civil Rights Act is laid out, forcing an employee into a religious activity would be a blatant disregard for their protected rights of religion. The employer could have said that all people, even if they aren't religious, would be forced to join. But that also violates the Act because an employer should not be asking about that.

Discrimination doesn't have to just be about not allowing someone in. In this specific case, the discrimination is putting the employee into an uncomfortable position of forced-joining in when it falls under the protected case of religion.

I didn't say there has to be but legal precedent matters. If there's a case just like this that has set the precedent that a situation like this is or isn't a violation then that's the ruling

And I can't imagine something almost identical hasn't ever made it to court

I mean I find it hard to believe there hasn't been a court case on something like this ever before. But obviously I don't know the case off the top of my head assuming I'm even right

Edit: I see how my wording could be confusing. The first post was just me speculating that a similar case has probably already set president, not that there literally has to have already been a case to establish it

idk if this applies to protected classes, though.

like, you can't just fire someone because you find out they're Muslim, for example.

I mean, you can, but you can't give that as a reason for firing them.

Not if that reason is protected by law, in this case the Civil Rights Act. An employer can't outright fire you for being a woman, being black, or (not) being religious. If the boss had said "it isn't working out, we're gonna have to let you go", that's one thing - especially in an at will state. If the boss explicitly states why you're terminated, and it's something protected under the purview of federal law, that's another. He has every right to sue.

Why would you be skeptical? A company cant fire you for having different religious beliefs. It sounds like that was the reasoning here. They didnt find another reason to do it. They cited his unwillingness to participate in a prayer as the reason. Thats definitely grounds for a legal case lol.

Because I'm just as entitled to be skeptical as you are to sit here and pretend you're a civil lawyer that really has any credibility to say something definitively.

Why are you having an emotional episode just because someone thinks this might not be a rock solid case?

I'm not really arguing with anyone, I just said I'm not sure it's a strong case. If the usual suspects want to come through to get butt hurt and throw around personal attacks just vanilla enough to evade moderation that's a bigger reflection of their character and intelligence than mine.

But hey, if you want to jump on that train more power to you.
